Mr. Draim has extensive litigation experience in state and federal courts, including jury and non-jury trials, as well as appellate arguments. A principal focus of Mr. Draim’s practice has been the defense of attorneys and law firms in legal malpractice actions and bar disciplinary proceedings. Mr. Draim has also defended attorneys, law firms and other professionals in claims asserted under the Fair Debt Collection Practices Act (FDCPA), the Fair Credit Reporting Act (FCRA), and the Telephone Consumer Protection Act (TCPA). In addition, Mr. Draim has appeared in state and federal courts throughout the country in products liability cases involving medical devices, asbestos, machinery and other products. Mr. Draim is the author of the principal treatise in Virginia on products liability law. He has defended construction defect claims, including claims involving building materials, structural issues, balconies, and fire protection systems. Mr. Draim has also defended premises liability claims, including lead paint, mold, pesticides, and third-party assaults on tenants. He has represented companies and their principals in contract and commercial litigation, including issues involving indemnification and confessed judgment provisions. Likewise, Mr. Draim has defended a wide variety of tort and personal injury claims, and he is the co-author of the principal treatise in Virginia on tort and personal injury law. Mr. Draim has also defended a number of defamation cases. In addition to litigating in state and federal courts, Mr. Draim has handled arbitrations and insurance appraisal proceedings. Mr. Draim has also resolved numerous cases in mediation, including pre-suit mediations as well as mediations prior to trial of litigated cases.
